Meet Nick Williams

As a pragmatic business litigator and investigator, Nick has helped businesses and individuals achieve their goals in a variety of challenging legal scenarios. Whether his clients confront litigation or regulatory scrutiny, Nick employs diligence, creativity, and financial acumen to serve his clients.

Business Litigation & Counseling

Nick acts as a representative and counselor to his clients when they face business disputes that may need to be resolved through litigation. Every day, businesses encounter a variety of disagreements, including disputes with a fellow business owner, an employee, a vendor, or a customer. Nick guides clients through difficult choices that arise both before and during litigation, while focusing on the business’s strategic and tactical goals.

Nick has experience counseling businesses of varying sizes, from start-ups to the Fortune 500, and in numerous industries. Examples of Nick’s business litigation and counseling experience include matters such as the following:

  • Litigating cases based on employment-based restrictive covenants and misappropriation of trade secrets.

  • Resolving contract disputes in a variety of industries, such as staffing, sales, finance, property management, real estate development, software development, and healthcare.

  • Handling disputed warranty claims on behalf of clients, ranging from a software developer to an automotive manufacturer.

  • Defending companies, like national healthcare providers and regional real estate developers, against class action lawsuits.

  • Defending businesses and their executives against government enforcement actions for alleged violations of various laws, such as the False Claims Act and Securities Act.

Nick’s practice includes defending clients who are the targets of administrative or prosecutorial scrutiny for their business practices. Too often, government regulators and prosecutors wield hindsight to condemn a professional’s or business’s actions, especially using ambiguous legal mandates. Nick effectively liaises with regulators and investigators, guiding inquiries toward reasonable resolutions for his clients.

  • Representing accounting firms facing allegations of misconduct brought by the Public Company Accounting Oversight Board and state boards.

  • Counseling local officials facing state ethics inquiries.

  • Investigating alleged antitrust violations brought by the Department of Justice.

Business Solvency

Nick combines business acumen, legal know-how, and coaching to lead debtors and creditors dealing with cash flow problems to achieve results. The fact is, some small businesses struggle to achieve financial success. As a former CPA, Nick understands how to evaluate a company’s financial status and which legal levers to push and pull to protect his clients and reach their goals.

Nick has handled insolvency matters for businesses in a variety of contexts, such as the following:

  • Collecting debts, negotiating forbearance agreements, and foreclosing on assets for institutional and individual lenders.

  • Prosecuting claims in bankruptcy for lenders and trade creditors.

  • Filing bankruptcy on behalf of a struggling shopping mall.

  • Renegotiating payment terms on behalf of debtors and creditors in the real estate development, entertainment, and food services industries.

Nick assists creditors by protecting their financial interests in troubled companies and distressed assets, and Nick helps troubled companies assess their options to reach the light at the end of the tunnel.

The Personal Side

Nick enjoys being active through pickleball, swimming, and hiking. Nick also enjoys reading and spending time with his amazing wife, Nicole.
